The Debtor’s name is Different?

Q: The debtor’s middle name is X, but on the agreement form, the Judgment Enforcer has his middle name listed as Y – should that be corrected first?

A: Judgment enforcers have access to (and pay for) many private databases – and the ones they used so far, probably showed the judgment debtor’s middle name as Y. The judgment enforcer wants to make their assignment and purchase agreement forms as accurate as possible. The judgment enforcer may find and add even more names and AKAs used by the debtor over time.

What matters is the judgment enforcer has identified the debtor by the case number and information they have gathered so far. On the separate assignment form – the middle name is not there – as court documents must use the exact name you or your lawyer specified – when you first sued your debtor.
